Social Security Schemes to Gramin Dak Sevaks : A small study

National Union (FNPO & NUGDS) Report to GDS Pay Committee & Directorate :

GDS ar deprived of the State Government welfare/ pension schemes which are available to common man, as the State Govt. consider the working/ discharged GDS as Central Govt.employee and reject their application on this ground.

There are several schemes launched by the Central & State Govt. for housing , health , emoyment etc. But the benefits of these programmes are not reaching to GDS and their family members because of their projected status as a Govt.employee.

For example in Andhra Pradesh & Telangana States , GDS are not eligible for issuing White Ration Card , medical re-embursement schemes like Aarogyasri & NTR Vaidhya Bheema , Housing schemes , childrens educational fee re-embursement , Old age pension etc. which were provided to all COMMON MAN living in these both States.

Therefore we are in the view , that the Central and State Governments not treated GDS as a COMMON MAN also.

Department View :

The GDS are not covered under CCS (Pension ) Rules,1972 and therefore , they are not entitled for any pension,GPF and other benefits . So, DoP has sympathytically designed some social security schemes to GDS i.e. Sevarance now called as Service Dischage Benefit Scheme (SDBS) ,Gratuity,Group Insurance etc.

Sevarance ( SDBS ):

For each completed year of service @1500/- up to 2011 and there after SDBS scheme is introduced . At present maximum amount payable to GDS to this scheme is Rs.60,000/-

Ex-Gratia Gratuity :

At present maximum amount payable to GDS to this scheme is Rs.60,000/-

Group Insurance Scheme : 

At present insurance coverage of Rs.50,000 with a monthly subscription of Rs.50 is available to all GDS. But it is not a attractive scheme when compared to PMJJBY.

Committee Recommendations :

In the above said two schemes , the GDS Committee recommended 1.5 Lakh to Sevarence amount with delinking the SDBS and 5 Lakhs to Gratuity.GIS recommended for 5 Lakhs with a monthly subscription of Rs.500.

But according to latest information, Severance & gratuity schemes are recommended @1.5 Lakh by the Greatest Departmental Committee who knows everything about GDS System and also who are enjoying on the slavery deaths of GDS.No change of insurance coverage of Rs.50,000 in case of GDS GIS.

Conclusion :

Rules must made according to Labour Laws and Constitution of India

But, not with in the four walls of the AC ROOM according to Department wish.

TWO DAYS RELAY HUNGER FAST IN FRONT OF ALL DIVISIONAL OFFICES ON 28th & 29th NOVEMBER 2017

The NFPE Federal Secretariat decided to continue the struggle programme on long pending charter of demands.
In the first phase, it is decided to conduct two days relay hunger fast infront of all divisional offices on 28th & 29th November 2017 with en mase participation of NFPE & AIPEU-GDS members. 

During the programme, it is requested to wear black badges / badges with demands with out fail.

Make the programme a grand success and report compliance to the respective CHQs at the earliest.

The Komlesh Chandra committee was constituted to study and make recommendations on the pay and service conditions of the GDS employees. The committee submitted its report on 27-11-2016 almost a year back. After scrutiny and approval by the Hon’ble Communication minister of state, the recommendations were forwarded to your ministry for your approval. As is learnt, some further clarification were sought by your hon’ble self. It is learnt that the same has been resubmitted for your honour’s approval.

It is almost a year since the report was submitted. The recommendation of the seventh CPC have been implemented long back. The GDS employees have been left high and dry. They are looking forward to your honour so that they may also get the benefit of pay revision etc as the departmental employees have already enjoyed.

Departmental building of Aliha Branch Post Office constructed by villagers of Aliha at their own contribution as a token of their love for the post office.
The new Departmental small building of Aliha Branch Post Office in account with Dungura Sub Post Office 758182 under Bhadrak Division in Odidha Circle was inaugurated on  12.10.2017 during celebration of National Postal Week. The build is constructed by Villagers under Aliha Branch Post Office unde the leadership of one villager-Shri Babaji Rae, with their own contribution as a token of love for the Post Office. The BO building stands over a patch of land measuring A003 decimal donated by Sri Sukadev Panda of Aliha village, registered in the name ofDepartment of Posts (on behalf of President of India). The villagers celebrated the inauguration by arranging a meeting at their own cost with provision of Prasad (vegetarian Meal) for all guests and audience. Sri B B Mohanty SPOs, Bhadrak who was invited as Chief Guest inaugurated the new BO building some other postal staff also attended the inaugural function on invitation.

GDS Current Status & Applicability of Articles 309 & 311 of Constitution of India

GDS Current Status & Applicability of Articles 309 & 311 of Constitution of India.
Article 309 & 311 both are related to Central Government employees.

In the above said para 8.17, Article 309 not covered to GDS.

In the above said para 8.18 , Article 311 applicable to GDS.
GDS Conduct & Engagement Rules ,2011 were not framed under Article 309 of the Constitution of India but under *executive powers of Central Government* after approval of the recommendations of the Nataraja Murthy Committee report.Thus these rules are also non statutory in nature.

According to Dept.of Posts and Government of India , One Article supports GDS (311) i.e.Statutory 

Second Article (309) not supported to GDS i.e non statutory ( which was framed by the Dept.only).

Why Department of Posts adopt that Rule in 2011?

Why they are not interested to amend or withdrawn the executive resolution ?

Is there any mercy on GDS by Directorate?

Past is past. At present RICT & IPPB roll out started.

At this juncture, Directorate must mandatatorily convince the Govt.of India and do favour to 2,70,000 GDS and their families.

If Department & Govt.of India withdrawn their executive resolution reg.GDS Conduct & Engagement Rules ,2011 on GDS employees , then 

All the GDS will automatically convert in to Central Government Employees with the applicability of Article 309 of Constitution of India.

CENTRAL TRADE UNION & INDEPENDENT FEDERATIONS RELAY DHARNA IN DELHI - 9TH NOV 2017

CENTRAL TRADE UNIONS AND INDEPENDENT FEDERATIONS HAVE DECIDED TO GO AHEAD WITH MAHA DHARNA AFTER TALKS WITH LABOUR MINISTER.

The Joint Platform of Central Trade Unions, comprising Central Trade Union Organisations and all major industry/establishment wise federations have decided to stage three days’ mass dharna before Parliament against the anti-worker, anti-people and anti-national policies of the Central Govt on 9-11 November 2017. The Joint Trade Union Platform represents workers and employees from all major sectors of industries and services viz., coal, steel, transport, telecom, petroleum, electricity, port & docks, engineering, construction, scheme-workers etc and employees of Central Govt and state govt, Railways, banks, insurance, defence production, etc. This ‘mahapadav’ is intended to demand the government to concede the unanimous demands which the joint trade union movement has been raising since the last over eight years. It is a step towards preparation for the next higher phase of united struggles including indefinite countrywide strike action, if the government continues to ignore the demands of the workers and proceed with its pro corporate agenda.

The anti-people and anti worker policies of Govt at the centre are inflicting horrific miseries and hardships on the crores of common people from every walk of life. Unemployment is getting aggravated with every passing day, calling the bluff on the Modi Govt’s promise of generating additional two crore employment every year. In fact employment generation has already turned negative following the increasing phenomenon of closure and shut-down of industries. Demonetisation, under the utterly false pretext of curbing black money, had further depressed wages and perpetuated closure of industries. It has shattered the entire economy, particularly the unorganised sector, the SME sector and the small traders and peasants in turn adversely impacting the lives, wages and earnings of crores of toiling people. Even after one year, the economy is yet to recover from its damaging impact. Hasty implementation of GST had further aggravated the miseries of people through fuelling price rise and jeopardising services, trade and various occupations. Despite the sharp fall in international price of crude oil, the government refuses to pass on the relief to the common people; instead, the prices of petrol, diesel and cooking gas are continuously increased resulting in cascading effect on the prices of all essential commodities.

The Govt has been arrogantly ignoring the 12 point charter of demands including minimum wage, social security and workers’ status and accompanying benefits for the scheme workers; it is going ahead with privatisation and mass scale contractorisation. The constitutional and statutory provisions for ensuring ‘same wages and benefits for same work’ are being denied to contract workers despite Supreme Court’s categorical judgment. The Govt has recklessly embarked upon privatisation of all public utility services like health, education, transport, Indian Railways, financial services electricity, water etc through multiple routes including whole sale outsourcing. It has allowed 100% FDI in almost all sensitive sectors including defence production, railways, oil, minerals, port and dock etc. It is destroying indigenous production capabilities to serve the interests of MNCs, under the dubious veil of “Make in India” slogan. The national interests are being severely compromised through such disastrous moves.

In addition, in order to promote “ease of doing business”, the Govt has embarked on arrogant pro-employer amendments of all labour laws aimed at imposing conditions of slavery on the working people. Already, the text of the Code on Wages Bill, Code on Industrial Relations Bill, Code on Social Security Bill, Factory (Amendment) Bill etc are in public domain. All these are designed to push the overwhelming majority of workers and employees out of the regulatory purview of most of the labour laws, curb workers’ right to form unions and protest/agitate including right to strike, and dismantle whatever existing meagre social security provisions.

Simultaneously, the communal forces, with the open and active patronage of the Govt and ruling polity are carrying out a dubious divisive and disruptive campaign to spread hatred among people, killing innocent people, particularly from the most downtrodden sections. The country is witnessing the conspiracy to create unprecedented disruption in the unity of the toiling people of the country. Trade unions are fighting against such disastrous designs of spreading poison of disruption in the society.

The Govt’s response to the 12 point charter of demands, in the meeting with all central Trade Unions called by the Labour Ministry on 7th November 2017, remains virtually negative on all counts reflecting their bias against the interests of the mass of the working people.

In totality, the policies of the Govt are destructive towards the interests of the workers, farmers and the common people at large and also against the national interest.

Representing the workers who generate the GDP and the wealth for the country, the true patriotic people concerned about welfare of all sections of toiling people, the Joint platform of united trade union movement is in a struggle to save the people and the country and force a reversal of the anti-people and anti-national policy regime. This determination is getting reflected in numerous struggles, agitations and strikes in various sectors of the economy, both organised and unorganised, during the intervening period. Lakhs of workers from all over the country and across the sectors are going to converge in the massive three days dharna before the Parliament on 9-11 November 2017 to pave the way for further heightened resistance struggle in the days to come to reverse and defeat the anti-people and anti-national policy regime in order to save the country and the people.
